Draft Planning Proposal for Land Acquisition Reservation, Otford Road, Lloyd Place, Otford and No.3 Undola Road, Helensburgh

Council is seeking community input on a draft Planning Proposal which, if made, would identify the land on the Wollongong Local Environmental Plan 2009 Land Reservation Acquisition Map for acquisition by Council for local open space.

Background

Council at its meeting on 29 July 2013 considered a series of reports on a draft Planning Proposal for the former 7(d) lands at Helensburgh, Otford and Stanwell Tops. The Planning Proposal is being reviewed and progressed by the NSW Department of Planning and Infrastructure.

The Department has recently announced that the Planning Proposal is being referred to the Southern Region Joint Regional Planning Panel (JRPP) for review and recommendations. The JRPP has also been requested to review the Pre-Gateway Appeal lodged by Smyth Planning on behalf of owners within the Lady Carrington Estate South and Land Pooling precincts, against Council decision to not support residential development in these precincts, in exchange for the dedication of bushland. At this stage, Council does not have specific details on the JRPPs process and timing for the reviews. Further details should become available on JRPP's website: http://www.jrpp.nsw.gov.au/

On 29 July 2013, Council also resolved to prepare a new draft Planning Proposal to identify 21 lots within the Lloyd Place, Otford precinct and 1 lot within the Camp Gully Precinct – Undola Road sub-precinct (No.3 Undola Road) on the Wollongong LEP 2009 - Land Reservation Acquisition Map as Local Open Space for Council acquisition. These lots are proposed to be zoned E2 Environmental Conservation by the earlier Planning Proposal.

In terms of the Lloyd Place precinct, Council noted that the lots were created in 1970 based on the 2 hectare subdivision development standard of the day, and a “country dwelling” was permissible, on each lot, however in 1971 the minimum lot standard increased and the land owners have been unable to erect a dwelling. Council resolved (in part) that:

3 A new draft Planning Proposal be prepared to identify the 21 lots within the Lloyd Place precinct which do not contain a dwelling house for acquisition, by identifying the lots on the Land Reservation Acquisition Map as being required for Local Open Space purposes. The draft Planning Proposal be submitted to the NSW Department of Planning and Infrastructure for a Gateway determination and requesting authorisation for the General Manager to exercise plan making delegations in accordance with Council’s resolution of 26 November 2012. If approved, the draft Planning Proposal be placed on public exhibition for a minimum period of 28 days;

In terms of 3 Undola Road, Council noted that the owner purchased the property in 1965 from Council, a dwelling house has not been able to be built on the land, and the lot is surrounded by land in other precincts which are proposed to be zoned E2 Environmental Conservation. Council resolved (in part) that:

5 A new draft Planning Proposal be prepared to identify 3 Undola Road, Helensburgh for acquisition, by identifying the lots on the Land Reservation Acquisition Map as being required for Local Open Space purposes. The draft Planning Proposal be submitted to the NSW Department of Planning and Infrastructure for a Gateway determination and requesting authorisation for the General Manager to exercise plan making delegations in accordance with Council’s resolution of 26 November 2012. If approved, the draft Planning Proposal be placed on public exhibition for a minimum period of 28 days.

If the Planning Proposal is progressed and finalised, the owners of the lots will be able to request that Council acquires the land for Local Open Space purposes. The timing of the acquisition is dependent on the finalisation of the Planning Proposal, the request from the land owner and Council financial resources. It is expected that it would take many years to acquire the lots. The Local Open Space designation identifies Council as the responsible acquisition authority, rather than a State agency. It is proposed that the lots would be maintained as bushland under the proposed E2 Environmental Conservation zoning.

The NSW Department of Planning and Infrastructure issued a Gateway determination on 13 November 2013 granting Council permission to exhibit the draft Planning Proposal.

Exhibition

The draft Planning Proposal is on exhibition between 24 March and 2 May 2014. Submissions close on Friday 2 May 2014.
