Variation to the Planning Agreement – Stockland Development – Bong Bong Road, Horsley

Consultation has concluded

Council at its meeting of 14 December 2015 resolved to exhibit a draft deed of variation to the Voluntary Planning Agreement (VPA) between Stockland Development Pty Ltd and Council.

In 2011, Stockland and Council entered into a VPA for Stockland’s development at Bong Bong Road, Horsley. The VPA required Stockland to:

  1. Pay section 94 development contributions of $29,205 (subject to indexation) per lot;
  2. Reconstruct Bong Bong Road (stage 1, 2 and 3) adjacent to Stockland property;
  3. Reconstruct Bong Bong Road between Fairwater Drive and Stockland property;
  4. Develop the stormwater detention basin and water quality control facilities;
  5. Construct a local park;
  6. Dedicate the environmental conservation (E2) land to Council;
  7. Dedicate the riparian corridor to Council;
  8. Dedicate the road reserve for Hayes Lane reconstruction;
  9. Construction of the intersection between Bong Bong Road and Hayes Lane;
  10. Develop and dedicate Lot 62 DP751278 as open space;
  11. Construction of the realignment of the intersection between Bong Bong Road and Glenlee Drive.

In 2012, Council and Stockland agreed to a variation to the VPA which amended the indexation clause within the agreement due to the NSW State Government cap of $30,000 on development contributions per residential lot/dwelling in West Dapto.

Stockland Development Pty Ltd have requested the second deed of variation to the Planning Agreement. The second deed of variation proposed an additional work item involving reconstruction of a section of Hayes Lane north of Bong Bong Road and adjacent to the Stockland property in Horsley. Other changes to the Agreement include amending the delivery timing in the work schedule and monetary contributions towards construction of a shared pathway on Lot 62 DP751278.

The draft Deed of Variation is on exhibition between 6 March 2017 and 3 April 2017.
